General Terms and Conditions – Olivyne

Article 1 – Definitions

In these General Terms and Conditions, the following definitions apply:

Withdrawal period: the period in which the consumer can exercise the right of withdrawal.

Consumer: a natural person not acting in a professional or commercial capacity who enters into a distance contract with the seller.

Day: calendar day.

Long-term contract: a distance contract relating to a series of products/services with ongoing delivery or obligations.

Durable medium: any means allowing the consumer or seller to store personal information for future reference.

Right of withdrawal: the right of the consumer to cancel the distance contract within the withdrawal period.

Seller: the party offering products/services remotely to consumers.

Distance contract: a contract concluded within a system for selling remotely using one or more communication methods.

Remote communication: means to conclude a contract without simultaneous physical presence.

Article 3 – Applicability

These terms apply to every offer, order, and distance contract between the seller and consumer. Consumers will be provided with these terms before completing a purchase.

If a contract is concluded electronically, the terms may also be shared electronically and stored by the consumer.

Specific product or service conditions may apply in addition to these terms. In case of conflicts, the most favorable condition for the consumer applies.

Invalid provisions do not void the entire contract. They will be replaced with legally valid terms as similar as possible.

Unforeseen situations will be handled in the spirit of these terms.

Article 4 – Offers

If an offer has limited validity or special conditions, it will be stated.

Offers are non-binding. Olivyne may change them at any time.

Product/service descriptions are accurate. Photos represent products but may slightly differ in color. Obvious errors are non-binding.

Offers include:

  • Prices (excluding customs/import duties)
  • Shipping costs
  • Contract conclusion steps
  • Withdrawal rights
  • Payment and delivery details
  • Offer validity
  • Remote communication charges
  • Contract storage
  • Error correction
  • Contract language
  • Applicable codes of conduct
  • Duration (for long-term contracts)
  • Available sizes, colors, and material

Article 5 – Contract

A contract is formed when the consumer accepts the offer and meets the conditions.

For electronic acceptance, the seller will confirm receipt immediately. If no confirmation is received, the consumer may cancel.

The seller ensures secure data transmission and a safe website environment. Online payments follow appropriate security standards.

The seller may assess a consumer's creditworthiness and cancel or modify orders if needed.

Upon confirmation, the consumer will receive:

  • Complaint contact details
  • Withdrawal information
  • Warranty and after-sales info
  • All details from the offer
  • Cancellation terms (for contracts over 1 year)
  • Contracts depend on product availability.

Article 6 – Right of Withdrawal

Consumers may withdraw within 30 days of receiving products. Items may only be tried as in-store. Products must be returned in original condition and packaging.

Withdrawal must be requested via email: info@olivyne.ca. After notification, the consumer has 30 days to return the item.

Return shipping is the consumer's responsibility.

If deadlines are missed, the purchase remains valid.

Article 7 – Withdrawal Costs

Consumers cover return shipping costs.

Refunds are processed within 30 days of receiving the return or proof of shipment.

Article 8 – Withdrawal Exclusions

Withdrawal is excluded for:

  • Custom or personalized items

  • Perishable goods

  • Price-fluctuating items

  • Magazines or newspapers

  • Unsealed audio/video/software

  • Unsealed hygienic items

Also excluded:

  • Accommodation, transport, catering, leisure

  • Services performed with express consent before withdrawal period ends

  • Gambling services

Article 9 – Prices

Promotional prices are fixed during the promotion unless VAT changes.

Market-driven price changes may be applied.

Price changes within 3 months allowed only by law. Later changes require consent and withdrawal rights.

Delivery is exclusive of duties/taxes, to be paid by the recipient.

Obvious pricing errors do not bind the seller.

Note: Olivyne is operated by a Dutch company. Products are shipped by international suppliers. Prices exclude local VAT/import duties, which are the buyer’s responsibility.

Article 10 – Warranty

The seller guarantees product compliance.

Complaints must be submitted within 30 days of delivery.

Warranty duration follows manufacturer policy.

Exclusions include:

  • Unauthorized repairs

  • Misuse

  • Regulatory changes affecting materials or production

Article 11 – Delivery

Delivery occurs at the address provided by the consumer.

Maximum delivery time is 30 days. After that, consumers may cancel.

In case of unavailability, an alternative may be offered. The seller covers return shipping if declined.

Risk passes to the consumer upon delivery.

Article 12 – Duration and Termination

Open-ended contracts may be cancelled with 1-month notice.

Fixed-term contracts can be cancelled at expiry with 1-month notice.

Magazine subscriptions renew for up to 3 months unless cancelled.

Article 13 – Payment

Payment is due within 7 business days from the withdrawal period start.

Payment information must be provided correctly.

Late payment may result in additional fees.

Article 14 – Complaints

Complaints must be reported within 7 days of discovering the issue.

We respond within 30 days, or provide a new response deadline.

If unresolved, a dispute resolution procedure will apply.

Complaints do not suspend contractual obligations.

Valid complaints may result in repair or replacement.

Article 15 – Governing Law

All contracts are governed by the laws of the Netherlands.
